These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the web-based application, information, tools, templates, features, functionality and services (collectively, the “Service”) provided by The Trustee for ABDULLA FAMILY TRUST doing business as Map Your Finance (ABN 78 913 852 862) (“we”, “us” or “our”), via mapyourfinance.com (the “Site”). By accessing or using the Service—including all information, tools, and functionality—you agree to be bound by these Terms. If you do not agree to all provisions of this Agreement, you may not use the Service.
1. ACCEPTANCE OF TERMS
By accessing or using the Service, you agree to be bound by these Terms of Service. To become a registered user (“User”) and access the full functionality of the Service, you must indicate your acceptance during the registration process. You may not use the Service or accept this Agreement if you are below the legal age of majority in your country of residence, or if you are prohibited by law from receiving or using the Service. By using the Service, you represent and warrant that you are at least 18 years old (or the legal age of majority in your jurisdiction), have the legal capacity to enter into this Agreement, and, if acting on behalf of an entity, have the authority to bind that entity to these Terms. Any violation of these Terms may result in the termination of your account and/or access to the Service, at our sole discretion and without prior notice.
2. DESCRIPTION OF SERVICE
The Service is a financial management tool operated by us. It allows Users to manually input financial data or upload CSV files to organize, track, and analyze their finances. The Service provides budgeting templates, reports, and analytical tools to help visualize and manage finances but does not include automated data aggregation, third-party banking integrations, or open banking APIs. Users are solely responsible for entering accurate financial information and for ensuring the accuracy, completeness, and formatting of any uploaded CSV files. The Service does not validate or verify this data. It does not display, endorse, or link to third-party financial products, services, or advertisements, and it is not a source of legal, tax, investment, or financial advice. The Service is intended solely for informational purposes, and Users are fully responsible for any financial decisions made using it. No guarantees are made regarding improved financial outcomes, forecast accuracy, or error-free functionality. You acknowledge that the Service’s effectiveness depends entirely on the accuracy and completeness of the data you provide, and you agree that we are not responsible for any losses, errors, or omissions arising from your use of or reliance on the Service.
3. USER REGISTRATION AND ACCOUNTS
To use the Service, you must register an account as a human User; automated registrations by bots, scripts, or similar methods are strictly prohibited. You must be at least 18 years old (or the age of majority in your jurisdiction) to register. Registration requires a valid email address and password ("Login Credentials"), and you agree to provide truthful, current, and complete information, updating it as needed. You are solely responsible for maintaining the confidentiality of your Login Credentials and for all activities conducted through your account, whether authorized or not. By providing your email address, you consent to receive legally required notices—such as policy updates and security alerts—electronically in either HTML or plain-text format. If you suspect unauthorized use of your account or a security breach, you agree to notify us immediately at support@mapyourfinance.com. We reserve the right to suspend or terminate accounts that show signs of compromised credentials or suspicious activity. You are responsible for keeping your email address and other account information up to date, and we are not liable for any failed communications due to outdated or inaccurate contact details.
4. USER RESPONSIBILITIES
You agree to use the Service only for lawful purposes and in compliance with all applicable federal, state, local, and international laws or regulations, including data export/import laws, as well as these Terms of Service. You may not exploit or harm minors, harass, threaten, or defame others, or transmit content that is fraudulent, abusive, discriminatory, or in violation of intellectual property rights. Unlawful or abusive activities, including sending spam or unsolicited promotions, are strictly prohibited. You must not disclose or publish your Login Credentials in a way that compromises security, nor introduce malicious code, attempt unauthorized access, or impair the Service’s functionality through actions like denial-of-service attacks. The use of bots, crawlers, or other automated tools to extract data without consent is not allowed, nor is reverse engineering or decompiling the Service. Commercial use, including reselling or sublicensing the Service without prior written authorization from us, is prohibited. You may not falsely imply any affiliation with us or misuse our trademarks or logos. Any conduct that restricts another User’s enjoyment of the Service or exposes us or other Users to legal risk is forbidden. You also agree to promptly report any violations of these Terms to support@mapyourfinance.com.
5. DATA HANDLING AND OWNERSHIP
You retain full ownership of all data you input or upload to the Service, including financial information, CSV files, and any other content ("User Data"). By submitting User Data, you grant us an irrevocable, non-exclusive, royalty-free, worldwide and transferable license to process, store, and display your User Data solely to operate and improve the Service. We will not sell, exchange, or release your User Data to third parties without your express permission, except as required by law or court order. We may use aggregated and anonymized data for analytical purposes to enhance the Service. Although we implement industry-standard security measures to protect your User Data, you acknowledge that no system is completely secure and that manual data entry and CSV uploads carry inherent risks. Your User Data will be retained for as long as your account is active, and it will be deleted from our servers upon account deletion, except as required to comply with legal obligations. By submitting User Data, you represent that you have the necessary rights to do so and that the data is accurate and lawful.
6. COPYRIGHT AND INTELLECTUAL PROPERTY
All content, templates, spreadsheets, documents, software, graphics, text, designs, layouts, features, functionality, and any other materials made available through the Site or the Service (collectively, the “Materials”) are the exclusive property of us, or our licensors, and are protected by Australian and international copyright, trademark, trade secret, and other intellectual property or proprietary rights laws.
You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Materials solely for your personal, non-commercial use in connection with the Service. You may not copy, reproduce, republish, upload, post, transmit, modify, create derivative works from, distribute, publicly display, publicly perform, or otherwise use or exploit any part of the Materials for any commercial or unauthorized purpose without the prior express written permission of us.
You are expressly prohibited from using any template, spreadsheet, or other content provided by us as a foundation to develop competing or derivative products, tools, or services—whether for personal use, resale, or redistribution. Any such use without express written authorization constitutes a violation of these Terms and may result in legal action.
No right, title, or interest in or to any content on the Site is transferred to you, and all rights not expressly granted are reserved by us. Unauthorized use of the Materials may result in termination of your access to the Service and legal consequences under applicable laws.

7. DISCLAIMERS
The Service is provided by us on an "as is" and "as available" basis. To the fullest extent permitted by law, we expressly disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or completeness of data, and uninterrupted, secure, or error-free operation. We do not warrant that the Service will meet your requirements, be available at any particular time, or function without interruptions. We disclaim responsibility for any harm or loss caused by errors, omissions, or inaccuracies in User Data or service outputs; unauthorized access to or alteration of your data; and technical failures, including server crashes or data loss. The Service does not provide, endorse, or guarantee any third-party products, services, or advice. Any financial decisions you make using the Service are at your sole risk. The Service is a tool for informational purposes only and does not constitute legal, tax, investment, or financial advice. Please consult a qualified professional for personalized guidance.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, we shall not be liable to you or any third party for any indirect, incidental, consequential, special, punitive, or exemplary damages (including but not limited to lost profits, lost revenue, lost data, business interruption, or reputational harm) arising from your access to or use of the Service; errors, omissions, or inaccuracies in User Data or service outputs; unauthorized access to, alteration, or deletion of your data; technical failures (e.g., downtime, bugs, or server crashes); or any actions or omissions in reliance on the Service’s functionality. This limitation applies whether the alleged liability is based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited under applicable law. The Service may contain links to third-party websites or resources, and we disclaim all liability for the content, accuracy, or practices of such third parties.
9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless us, our trustees, affiliates, employees, and agents (collectively, the “Indemnified Parties”) from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to your access to or use of the Service, including any data you input, upload, or share; your reliance on the Service’s outputs or recommendations for financial decisions; your violation of any provision of these Terms; your failure to maintain the security or confidentiality of your account or Login Credentials; your infringement of any third-party right, including intellectual property, privacy, or contractual rights; claims resulting from inaccurate, incomplete, or unlawful User Data; and your misuse of the Service for fraudulent, abusive, or illegal activities. This indemnification obligation applies regardless of whether the claim arises from negligence, breach of contract, or any other legal theory, and it survives termination of your account or these Terms. The Indemnified Parties reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification under this section. You agree to cooperate fully in the defense of any claim.
10. TERMINATION
You may terminate your account at any time using the account closure tools within the Service. We reserve the right to suspend or terminate your access to the Service, with or without notice, for any reason, including but not limited to violations of these Terms or requests by law enforcement or regulatory authorities. All rights granted to you under these Terms will cease immediately. You will lose access to User Data stored in the Service. We are not obligated to retain your data after termination and may delete it permanently. Provisions of these Terms that inherently survive (e.g., indemnification, disclaimers, limitation of liability) will remain in effect.
11. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by and construed in accordance with the laws in force in the State of Victoria, Australia. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Victoria and applicable federal Australian courts.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes amicably through good-faith negotiations, initiated by one party giving written notice of the dispute to the other party. You must notify us in writing at support@mapyourfinance.com detailing the dispute, and we will respond within thirty (30) business days.
If a dispute remains unresolved within sixty (60) business days of a party receiving written notice of the dispute, the dispute will be referred to mediation administered by the Australian Disputes Centre (ADC) in accordance with its guidelines.
In the event the dispute is not resolved by mediation within forty (40) business days after the appointment of the mediator, or such further time as the parties agree in writing, the dispute will be resolved by binding arbitration in Melbourne, Victoria, under the ADC’s Arbitration Rules. You agree to resolve disputes individually, not as part of a class, consolidated, or representative action. This waiver applies to arbitration and court proceedings where permitted by law. Either party may seek urgent injunctive relief (e.g., intellectual property infringement, data breaches) in the courts of Victoria without first participating in mediation or arbitration.
12. MODIFICATIONS TO TERMS
We may update these Terms at any time. Changes will be posted on the Site, and material revisions will be notified via email or in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you disagree, you must cease using the Service immediately.
13. MISCELLANEOUS
If any provision is deemed unenforceable, the remaining Terms remain valid and enforceable. These Terms supersede all prior agreements and constitute the complete understanding between you and us. You may not assign your rights under these Terms without our written consent, but we may assign our rights to any successor (e.g., in a merger or acquisition). Only we and Users have rights under these Terms. No third party may enforce any provision. Failure to enforce a provision does not waive our right to enforce it later.
